Halifax Board of Health Withdraws Holmes Street Violation, Cites Wrong Regulation

HALIFAX -- July 15, 2026, Halifax Board of Health unanimously withdrew a notice of violation against a commercial property at 285 Holmes Street after an attorney argued the cited state sanitary code provision applies only to residences. Health Agent Robert Buker backed withdrawal, telling the board the violation letter was issued by a consultant during a staff transition period and did not bear his name; the fire chief who responded to the original hydraulic fluid spill had consulted with the state Department of Environmental Protection and confirmed no Massachusetts Contingency Plan requirements were triggered. The board also discussed a $1,000 fine, the mandatory state minimum, issued to Lindy's General Store on Monponsett Street after a regional tobacco control compliance check found the store sold a tobacco product to a minor, its first such violation. Buker briefed members on a class action lawsuit involving Halifax, other towns, and the state Department of Public Health over tobacco enforcement, saying town counsel and DPH are managing the matter.
