Halifax Conservation Commission corrects prior RDA ruling, clears tree removal at Elm Street
HALIFAX -- June 9, 2026, Halifax Conservation Commission corrects an RDA error and flags a lakefront dumpster complaint at June 9 meeting. The commission unanimously reversed a positive Determination of Applicability issued the prior week for tree removal at 399 Elm Street, with agent Dan LeVangie acknowledging the original finding would have incorrectly required a full Notice of Intent; the board substituted a negative determination with a single post-removal inspection condition. LeVangie also reported that a property owner on East Monponsett Pond at 98 Holmes Street appears to be operating a commercial dumpster business on lakefront land, with open, rusting dumpsters draining toward the pond, the commission plans to send a formal removal letter after the building inspector exhausted his own options. A Certificate of Compliance for a nursery at 539 Plymouth Street was tabled after members said a previously voted prohibition on dyed mulch storage was not captured in the written special order of conditions; LeVangie will review prior meeting minutes before the June 23 meeting.
